The European Banking Authority (EBA) has initiated a public consultation on proposed revisions to the Implementing Technical Standards (ITS) governing the joint decision process for institution-specific prudential requirements, as outlined in Article 113 of the Capital Requirements Directive.

The revisions aim to simplify and improve the efficiency of the regulatory and supervisory framework, reflecting developments since 2014, including changes introduced by CRD V and updated EBA Guidelines on the Supervisory Review and Evaluation Process (SREP).

The proposed amendments include:

The goal is to enhance the efficiency and consistency of supervisory assessments and communication to institutions.

Comments can be submitted via the EBA’s consultation page by clicking the “send your comments” button. The deadline is 4 January 2027 at 23:59 CEST.

A virtual public hearing will be held on 10 November 2026 from 10:00 to 11:00 CEST. Stakeholders can register by 9 November at 16:00 CEST. Dial-in details will be provided to registered participants.

All comments received will be published after the consultation unless confidentiality is requested.

This consultation supports the EBA’s broader efforts to improve EU banking regulation efficiency, as part of its campaign “Simplifying to strengthen,” aligned with the Report on the efficiency of the regulatory and supervisory framework published on 1 October 2025.

The revisions are based on Article 113(5) of Directive 2013/36/EU (CRD), which mandates the EBA to develop standards for the joint decision process on prudential requirements for cross-border banking groups within supervisory colleges.

The existing ITS were adopted under Commission Implementing Regulation (EU) No 710/2014, establishing procedures, timelines, and templates for joint decisions on capital and liquidity requirements within supervisory colleges.
