EBA consults on rules to enhance depositor protection under revised deposit guarantee schemes directive

The European Banking Authority (EBA) has launched four public consultations on proposed rules to strengthen depositor protection, improve information exchange, and harmonise standards across the EU under the revised Deposit Guarantee Schemes Directive. Comments are due by October 23, 2026.

The European Banking Authority (EBA) has launched four public consultations on proposed rules to further strengthen depositor protection, preserve financial stability, and harmonise depositor protection standards across the EU under the revised Deposit Guarantee Schemes Directive (DGSD3).

The consultations cover: Implementing Technical Standards (ITS) on depositor information, ITS on information exchange between credit institutions, Deposit Guarantee Schemes (DGSs) and authorities, Regulatory Technical Standards (RTS) on client funds protection standards, and Guidelines (GL) on DGS investment of collected funds. The consultation period runs until 23 October 2026.

The draft ITS on depositor information specify harmonised content and formats for depositor information sheets at account opening and during bank failures. They aim to improve depositor awareness of coverage while allowing communication flexibility without increasing administrative burden.

The draft ITS on information exchange introduce standard procedures, templates, and minimum requirements for reporting in bank failure scenarios. They also aim to enhance reporting from DGSs to the EBA, improve transparency on the use of DGS funds, and ensure timely, accurate, and proportionate information exchange.

The draft RTS on client funds establish rules to ensure DGSs receive necessary data to identify and reimburse clients holding funds in intermediary accounts. They clarify reimbursement procedures and measures to prevent duplicate payouts, promoting operational efficiency and legal certainty across the EU.

The draft Guidelines on DGS investment set out how funds should be invested to ensure diversification, low risk, and liquidity, supporting rapid mobilisation for depositor reimbursement and other interventions under DGSD3.

Comments can be submitted via the respective web pages by clicking the “send your comments” button. The public hearing will be held on 24 September from 10:00 to 13:00 CEST. Registration deadline is 21 September 2026, 12:00 CEST.
