The European Banking Authority (EBA) has launched a consultation on draft technical standards for reclassifying investment firms as credit institutions when assets exceed EUR 30 billion. Comments are due by November 25, 2026.
The European Banking Authority (EBA) has initiated a consultation on three draft Regulatory Technical Standards (RTS) regarding the reclassification of investment firms as credit institutions. This applies when firms exceed the EUR 30 billion total assets threshold.
The proposals clarify how to calculate total assets, reporting requirements for investment firms, and conditions under which authorities can grant waivers allowing firms to operate under an investment firm authorisation instead of a credit institution license.
The revised RTS incorporate 2024 amendments to the Capital Requirements Directive (CRD) and aim to promote a proportionate, risk-based framework for investment firms.
Under the CRD, investment firms with assets over EUR 30 billion must obtain a credit institution authorisation.
The consultation is open until 25 November 2026. Comments can be submitted via the EBA consultation page. A virtual public hearing will be held on 30 September 2026 at 10:00 CEST, with registration open until 25 September 2026 at 16:00 CEST. Details will be provided to registered participants.
All comments received will be published unless confidentiality is requested.
